The good news is that because of Covid, many states have passed new food laws in the last two years that have broadened the scope of what cottage food producers are allowed to sell. For instance, the Montana Food Freedom Law, which was signed into law in April 2021, has made it possible for food entrepreneurs to sell food from their homes. You are also allowed to sell food plates in states such as Oklahoma, Wyoming, and North Dakota.
Unfortunately, selling home-cooked food to the public is still not allowed in many states. For instance, selling cooked meals or similar food from home in Florida is still not allowed, and so is selling food from Washington state. So, before you start thinking about an app for selling home-cooked food or investigating whether your state permits selling homemade food online, you first need to check whether you’re allowed to produce and sell perishable goods in your state.
So, what about selling food from home in California? If you’re a resident in this state, you’ll be happy to learn that California is one of a handful of states that do allow the selling of homemade meals from home. Although the cottage food laws in California don’t allow for the selling of non-perishable goods, new laws that were passed in 2018 and 2021 have expanded the rights of cottage food producers.
Under the Microenterprise Home Kitchen Operations (MEHKO), which was passed in 2019, home-based entrepreneurs are able to sell food plates, including those that contain meat, from home. There’s a caveat, however. The county in which you live needs to opt into this law. Up-to-date, many counties in California are yet to adopt this law, so you’ll need to check whether your county allows for the selling of food plates. If it does, you’ll need to find out how to sell food from home legally. You do, for instance, need a permit and also food handler training.
Unfortunately, the Illinois cottage food law prohibits the selling of homemade goods. Selling food from home in Chicago is, therefore, still not possible. As is the case in most states, you’re allowed to sell non-perishable food items from home, which excludes many foods such as meat, poultry, seafood, shellfish, green leaves, fresh tomatoes, and refrigerated baked goods. If you decide to sell permitted food items, such as jellies or bread, you’ll need a home kitchen license in Illinois. The state also requires food handler training.
